What Are VOCs?
Volatile organic compounds (VOCs) are chemicals that can be released into indoor air from certain products, materials and building activities. Common sources include paints and coatings, adhesives, cleaning products, furnishings, flooring, building materials and some commercial or industrial operations.
Because VOCs include many different compounds and potential sources, VOC concerns should be evaluated in the context of the building and the specific condition being investigated.
When Is VOC Testing Needed?
VOC testing may be appropriate when a commercial property has persistent chemical or solvent-like odors, occupant complaints associated with a particular area, or concerns following the introduction of new materials, products or building activities.
Common situations include:
Persistent or unexplained chemical odors
New flooring, furniture or building materials
Painting, coatings, adhesives or recent renovations
Cleaning products or chemical use
Manufacturing or operational processes
Tenant improvements or newly occupied spaces
Suspected outdoor or adjacent-property sources
IAQ concerns where a chemical source is suspected
CRB's Approach to VOC Testing
VOC testing is most useful when it is designed around the specific concern being investigated. CRB evaluates reported concerns, potential sources, building conditions and HVAC or ventilation factors before determining an appropriate testing strategy.
Rather than applying the same VOC testing package to every property, our consultants select sampling methods and parameters based on the building and the purpose of the investigation.
Our VOC Investigation Process
Once contamination has been identified, it is important to determine which regulatory program applies to the site. Regulatory requirements can affect notification, site assessment, reporting, cleanup criteria, corrective action, monitoring, and closure.
A contaminated property in Miami-Dade County may be subject to local, state, or federal environmental requirements, depending on factors such as the contaminant, source of the release, property history, and applicable cleanup program.
Relevant requirements may include Miami-Dade County Chapter 24, Florida's Chapter 62-780, F.A.C., Contaminated Site Cleanup Criteria, and the Contaminant Cleanup Target Levels established in Chapter 62-777, F.A.C., as well as other state or federal requirements depending on the site.
Not every contaminated property follows the same regulatory process. Identifying the applicable program early helps establish what assessment, documentation, corrective action, and closure requirements apply.
Miami-Dade Risk-Based Corrective Action
Miami-Dade County Chapter 24 establishes a Risk-Based Corrective Action (RBCA) process for contaminated properties within its jurisdiction that are required to conduct pollution remediation and are not eligible for specified State of Florida cleanup provisions identified by the County.
The County's RBCA framework addresses discovery and notification, assessment, natural attenuation, risk assessment, remediation, and No Further Action with Conditions, among other site-rehabilitation requirements. The specific requirements and available pathways depend on the regulatory status and environmental conditions of the property.
5. Determine the Appropriate Corrective Action
The presence of contamination does not automatically mean that active remediation is required.
The appropriate response depends on the contaminants present, concentrations, affected environmental media, nature and extent of impacts, potential exposure pathways, site conditions, applicable cleanup criteria, and regulatory program.
Depending on the applicable program and site-specific conditions, the path forward may include active remediation, Natural Attenuation with Monitoring, risk assessment, risk-based closure strategies, institutional or engineering controls, or other corrective-action approaches allowed by the governing regulatory framework.
Environmental Remediation
When active remediation is required, the remedial approach is developed around the contaminants and environmental conditions at the site.
Remediation may address contaminated soil, groundwater, sediment, surface water, source material, or other affected media, as applicable. Potential approaches can include source removal, treatment, containment, or other remedial technologies selected based on site-specific conditions and regulatory requirements.
Risk-Based Corrective Action
Risk-based corrective-action approaches consider site-specific conditions, contaminant concentrations, exposure pathways, and potential risks to human health and the environment when evaluating appropriate assessment, remediation, risk-management, and closure strategies.
Depending on the applicable regulatory program and site conditions, risk-based closure may involve alternative cleanup target levels and institutional or engineering controls where allowed and appropriately approved.
6. Remediate and Monitor the Contaminated Property When Required
When active remediation is required, the remedial strategy is developed based on the contaminants, affected environmental media, source and extent of impacts, hydrogeologic conditions, exposure pathways, applicable cleanup criteria, regulatory requirements, and site-specific conditions.
Under Chapter 62-780, F.A.C., a Remedial Action Plan (RAP) is required when active remediation is required. The RAP establishes the proposed remedial approach and addresses the contaminated environmental media subject to remediation.
Performance monitoring may be required during active remediation to evaluate the effectiveness of the remedial action. Following completion of active remediation, Post Active Remediation Monitoring (PARM) may also be required, particularly where groundwater contamination is involved, unless the applicable conditions for an exception or another approved pathway are satisfied.
The objective is to satisfy the requirements of the applicable regulatory program and progress toward an appropriate site-closure endpoint.
7. Work Toward Regulatory Closure
Once the applicable assessment, remediation, monitoring, or other site-rehabilitation requirements have been satisfied, a contaminated site may become eligible for No Further Action (NFA) or another applicable regulatory closure determination.
Under Chapter 62-780, F.A.C., the available closure pathway depends on factors including contaminant concentrations, affected environmental media, applicable cleanup target levels, site-specific risk considerations, and whether institutional or engineering controls are necessary.
No Further Action Without Controls
Under Chapter 62-780, No Further Action without Controls is available when the applicable criteria of Rule 62-780.680(1), F.A.C., are satisfied.
Among other requirements, FDEP describes this pathway as requiring contaminant concentrations in applicable environmental media to meet the specified cleanup criteria and the absence of free product. When the closure requirements are satisfied, the Department may issue a Site Rehabilitation Completion Order (SRCO).
No Further Action With Controls
Chapter 62-780 also provides pathways for No Further Action with Controls when the applicable requirements are satisfied.
These pathways can allow contamination to remain under approved risk-management conditions and may involve institutional controls and, when necessary, engineering controls to manage exposure and protect human health and the environment. The specific controls and closure requirements depend on the site conditions and applicable risk-management option.
Can You Buy or Develop a Contaminated Property in Miami?
Yes, in some circumstances. The presence of contamination does not automatically prevent a property from being purchased or redeveloped. However, contamination can create regulatory, technical, financial, and legal considerations that should be evaluated before proceeding.
Buyers and developers should understand the nature and extent of contamination, regulatory status of the site, applicable site-rehabilitation requirements, potential remediation or monitoring obligations, project schedule, and anticipated closure strategy.
Environmental conditions can also create important liability considerations. Environmental consultants evaluate the technical environmental condition of the property; qualified environmental counsel should advise buyers and other parties regarding legal liability, contractual risk allocation, and potential statutory liability protections.
